**Terms of Service for the Partee Golf Club, LLC Golf Simulator Rental Affiliate Program**
1. **Introduction**
These Terms of Service (“Terms”) govern your participation in the Partee Golf Club, LLC (“Company”, “we”, “us”, “our”) Golf Simulator Rental Affiliate Program (the “Program”). By participating in the Program, you agree to these Terms.
2. **Eligibility**
To participate in the Program, you must be at least 18 years of age and possess the legal authority to enter into this agreement.
3. **Registration and Approval**
To become an affiliate, you must complete the affiliate registration process. Your participation is subject to our review and approval. We reserve the right to reject or remove affiliates at our sole discretion.
4. **Commissions**
Affiliates will earn a commission of 10% of the total booking fee (excluding taxes, fees, or other additional costs) for each successful booking made through their unique referral link.
The average booking is $1000 = $100 minimum commission per sale.
5. **Payment**
Commissions will be paid on a monthly basis on the 5th of each month, provided the accumulated commission amount exceeds $99. If the commission does not reach this amount, it will be carried over to the next month.
6. **Tracking and Reporting**
We will provide affiliates with tracking and reporting tools. Affiliates can review their referral sales and commission status within their affiliate dashboard. We are not responsible for any technical issues that might prevent accurate tracking of referrals.
7. **Promotional Activities**
Affiliates are allowed to promote the Program through their websites, social media channels, and other online platforms. However, any use of our brand name, logo, or other intellectual properties must adhere to our brand guidelines.
8. **Prohibited Activities**
Affiliates are not permitted to:
– Use any form of spam or unsolicited promotional tactics.
– Make false or misleading statements about our products or services.
– Engage in any form of negative marketing or defamation against our brand.
– Use their referral link for their own bookings or to earn commissions on their own purchases.
9. **Term and Termination**
The term of this Agreement will begin upon our approval of your Program application and will end when terminated by either party. We can terminate this Agreement at any time, with or without cause, by giving written notice. If you breach any terms of this Agreement, your participation in the Program may be terminated immediately.
10. **Liability Limitation**
Partee Golf Club, LLC will not be liable for indirect, special, or consequential damages arising in connection with this Program. Our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the affiliate under this Agreement.
11. **Modification**
We may modify any terms and conditions within this Agreement at any time. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in the Program after a change will indicate your agreement to the changes.
12. **Miscellaneous**
This Agreement will be governed by and interpreted in accordance with the laws of the State of New York, without reference to its rules regarding conflicts of law. Any disputes arising out of this Agreement shall be adjudicated in the state and federal courts of New York.
13. **Acceptance**
By registering for the Partee Golf Club, LLC Golf Simulator Rental Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
